Order of Acting Minister for Investment and Development of the Republic of Kazakhstan dated January 28, 2016 № 118

On approval of Rules for registration, use and allocation of domain names in the space of the Kazakhstan segment of the Internet. Abolished.

In accordance with subparagraph 56) of Article 7 of the Law of the Republic of Kazakhstan dated November 24, 2015 "On informatization" I hereby ORDER:

1. To approve enclosed Rules for registration, use and allocation of domain names in the space of the Kazakhstan segment of the Internet.

2. To recognize as invalid:

  • 1) Order of the Minister for Communication and Information of the Republic of Kazakhstan dated September 7, 2010 № 220 "On Approval of Rules for registration, use and allocation of domain space of the Kazakhstan segment of the Internet" (registered in the Register of state registration of normative legal acts under № 6523, published on November 6, 2010 in the newspaper "Kazakhstanskaya Pravda" № 295-296 (26356-26357);
  • 2) Order of the Minister of Communication and Information of the Republic of Kazakhstan dated October 21, 2011 № 319 "On Amendments to the Order of the Minister of Communications and Information of the Republic of Kazakhstan dated September 7, 2010 № 220" On Approval of Rules for registration, use and allocation of domain space of the Kazakhstan segment of the Internet" (registered in the register of state registration of normative legal acts under № 7299, published on 21 December, 2011 in the newspaper "Kazakhstanskaya Pravda" № 412 (26803).

3. Committee of Communication, Information and Informatization of the Ministry for Investment and Development of the Republic of Kazakhstan (Kazangap T.B.) must provide:

  • 1) state registration of the present order in the Ministry of Justice of the Republic of Kazakhstan;
  • 2) a copy of the present order in a print and electronic form for the official publication in periodicals and information-legal system "Adilet" within ten calendar days after its state registration in the Ministry of Justice of the Republic of Kazakhstan and the Republican Center of Legal Information within ten calendar days from the date of receipt of the registered order to be included in the reference control bank of regulatory legal acts of the Republic of Kazakhstan;
  • 3) placing of the present order on the Internet resource of the Ministry of Investment and Development of the Republic of Kazakhstan and on the Internet portal of the public authorities;
  • 4) within ten working days after the state registration of the present order in the Ministry of Justice of the Republic of Kazakhstan representation in the Legal Department of the Ministry for Investment and Development of the Republic of Kazakhstan information on the performance of the activities provided in subparagraphs 1), 2) and 3) of paragraph 3 of the present order.

4. To assign control of execution of the present order to supervising Vice-Minister for Investment and Development of the Republic of Kazakhstan.

5. The present order shall come into force after ten calendar days after its first official publication.

Rules for registration, use and allocation of domain names in the space of the Kazakhstan segment of the Internet

1. General Provisions

1. The present Rules for registration, use and allocation of domain names in the space of the Kazakhstan segment of the Internet (hereinafter - Rules) are developed according to subparagraph 56) of Article 7 of the Law of the Republic of Kazakhstan dated November 24, 2015 "On Informatization" (hereinafter - the Law) and determine the procedure registration, use and allocation of domain names in the space of the Kazakhstan segment of the Internet.

2. In the present Rules the following main terms and abbreviations shall have the following meanings:

  • 1) An authorized body in the field of information (hereinafter - authorized body) is the central executive body responsible for management and interbranch coordination in the field of information and "electronic government";
  • 2) Top level domain name in the space of the Kazakhstan segment of the Internet is the domain name .KZ and .ҚАЗ, alloted by the international organization Internet Corporation for Assigned Names and Numbers (hereinafter - ICANN) for use in the interests of the Republic of Kazakhstan, located in the hierarchy of domain space in the Kazakhstan segment of the Internet a step below the root of the domain name and is the direct subdomain of the root domain (RFC-882);
  • 3) Domain name is a character (alphanumeric) designation, formed in accordance with the Internet addressing rules corresponding to a specific network address, and intended for the named object reference of the Internet;
  • 4) Domain name registration means entry of the provided by a Registrar information about a domain name in the domain name Register following an Applicant's Application by the Registry of the domain names in the space of the Kazakhstan segment of the Internet;
  • 5) Domain Name System (hereinafter - DNS) is a distributed database for information about domain names. It contains information about correspondence of domain names and Internetwork Protocol (IP) addresses, and operates in accordance with RFC-1032, RFC-1034, RFC-1035, RFC-1122, RFC-1133, RFC-1591;
  • 6) Space of the Kazakhstan segment of the Internet is a complex of the online resources which are placed on the hardware-software complexes located on the territory of the Republic of Kazakhstan;
  • 7) Second-level domain name in the space of the Kazakhstan segment of the Internet (hereinafter - second-level domain name) is a domain name located in the hierarchy of domain space of the Kazakhstan segment of the Internet on a step below a first-level domain in the space of the Kazakhstan segment of the Internet and is an immediate (direct) subdomain of a first-level domain name (RFC-882);
  • 8) Administrator of domain names in the domain space of the Kazakhstan segment of the Internet (hereinafter - manager) is a non-profit public organization defined by the authorized body, carrying out the development of the domain space of the Kazakhstan segment of the Internet;
  • 9) Internet resource is an electronic information resource that is displayed in text, graphic, audiovisual or other form, is placed on a hardware-software complex, which has a unique network address and (or) a domain name and functioning in the Internet;
  • 10) Application is a domain name registrant's request to a domain name Registrar in the space of the Kazakhstan segment of the Internet, which contains all the information for domain names registration in the space of the Kazakhstan segment of the Internet (prolongation of registration period), change previously provided information, transfer or cancel an existing domain name registration;
  • 11) Root domain name is a domain name, indicated with the point ".", which operates in the Internet based on the RFC-882 standard;
  • 12) Registrant of domain names (hereinafter - Registrant) - individual or legal entity sent an application for a domain name registration in the space of the Kazakhstan segment of the Internet and which owns the domain name at the time of the domain name registration in the space of the Kazakhstan segment of the Internet;
  • 13) Register of domain names in the space of the Kazakhstan segment of the Internet (hereinafter - Register) - a centralized complex of databases of all domain names registered in the space of the Kazakhstan segment of the Internet which contains all the information about registered domain names;
  • 14) Domain name register maintenance is maintenance of the domain name register in the space of the Kazakhstan segment of the Internet, possibility of making changes to the register by registrars, delegation of domain names and submitting all current information about registered domain names via WHOIS-server;
  • 15) Registry of domain names in the space of the Kazakhstan segment of the Internet (hereinafter - Registry) - a legal entity maintaining the registry of domain names in the space of the Kazakhstan segment of the Internet and supporting the stable functioning of the Kazakhstan first-level domain name in the space of the Kazakhstan segment of the Internet;
  • 16) Registrar of domain names in the space of the Kazakhstan segment of the Internet (hereinafter - Registrar) - a legal entity, resident of the Republic of Kazakhstan, accredited by Administrator of domain names in the space of the Kazakhstan segment of the Internet to provide services for domain name registration, entry of a domain name information in the Registry in the space of the Kazakhstan segment of the Internet, ensuring the right of a registrant of domain names to use a domain name on the basis of agreements between Registry and Registrant;
  • 17) Third-level domain name in the space of the Kazakhstan segment of the Internet (hereinafter - third-level domain name) - a domain name that is in the hierarchy of domain space of the Kazakhstan segment of the Internet one step below the second-level domain names in the space of the Kazakhstan segment of the Internet and that is the direct subdomain of the second-level domain name in the space of the Kazakhstan segment of the Internet (RFC-882);
  • 18) DNS-server - special software for the domain name service system, and the equipment on which the software is executed;
  • 19) Document Request for Comments (RFC) - a standard that defines the technical and organizational conditions for the functioning of the Internet and received by social organizations Internet Engineering Task Force and the Internet Engineering Steering Group;
  • 20) WHOIS-server - a specialized software designed to obtain information about registered domain names, operating according to RFC-3912, and the hardware on which the software runs.

2. The procedure for registration of domain names in the space of the Kazakhstan segment of the Internet

3. Registration of domain names using the domain name ".KZ" and ".ҚАЗ" is carried out with the aim of addressing Internet resources located in the space of the Kazakhstan segment of the Internet.

4. For registration of the domain name Registrant provides an application to Registrar according to the Annex to the present Rules with accurate and complete information in electronic or paper form (hereinafter - application).

5. All applications are considered in the order they are received by Registrar in accordance with the fixed time of sending to Registrar.

6. Registrar within 3 working days of receipt of a Registrant application shall verify:

  • 1) applications for compliance with the requirements of the present Rules;
  • 2) accuracy and completeness of the information specified in the application;
  • 3) accessibility for registration of the requested domain name at the time of filing the application;
  • 4) compliance of the requested domain name to the Internet standards: RFC-1032, RFC-1034, RFC-1035, RFC-1122, RFC-1133, RFC-1591;
  • 5) absence of a requested domain name in the list of reserved domain names referred to in paragraph 30 of the present Rules;
  • 6) absence of an enforceable court decision to ban the use of a registered domain name;
  • 7) absence in the content of a requested domain name information prohibited by the laws of the Republic of Kazakhstan.

7. In case of non compliance of the requested domain name to one or more conditions set out in paragraph 6 of the present Rules, Registrar returns a request to Registrant.

8. In the case of compliance of the requested domain name to all conditions set out in paragraph 6 of the present Rules, Registrar concludes a domain name registration agreement (hereinafter – Agreement) with a Registrant and makes information about registered domain names in the registry.

9. Domain names are considered registered when information about them is added to the Register.

10. Registrant shall inform Registrar of any changes of personal data of an individual or a legal entity specified in the agreement, no later than 10 working days from the date of such changes.

11. When Registrar receives information on personal data or change of the legal entity specified in the agreement he makes changes to the Register within 3 business days of receiving the information from Registrant.

12. If Registrant intends to transfer the domain name to use to another person or entity, Registrant notifies Registrar of his intention by indicating the information on the person who is supposed to transfer the rights to use the domain name.

13. Registrar makes the necessary changes to the registry within 3 working days of receipt from the registrant of the information on change.

14. No less than 20 working days before the expiry of Agreement Registrar shall send the relevant information to the registrant.

15. If Registrant refuses to use the domain name in the future he sends information of the expected date of termination of the agreement to Registrar, not later than the expiry date of the agreement.

16. Registrar deletes the domain name from the registry within 3 working days from the date of cessation of use of the domain specified in the information by the registrant, and inform the registrant of the termination of the agreement.

3. Order of use of domain names in the space of the Kazakhstan segment of the Internet

17. A domain name in the space of the Kazakhstan segment of the Internet is suspended when:

  • 1) detection of incomplete or unreliable information about the registrant specified in the application for registration of a domain name;
  • 2) the location of the hardware-software complex, which hosts an online resource with a registered domain name outside the territory of the Republic of Kazakhstan;
  • 3) detection of malicious software on the Internet resource posing a threat to the safe use of the Internet;
  • 4) there is an enforceable court decision on the suspension of the use of the domain name.

18. In the case of violations associated with the use of a domain name, set out in paragraph 17 of the present Rules, the registry after handling of the authorized body sends information to the registrar with indication of the violation.

19. Registrar shall suspend a domain name within one working day and send information to the registrar of the need to eliminate the reason of suspension of the domain name in the space of the Kazakhstan segment of the Internet.

20. When Registrar receives the information from the Registry, he informs registrant about the need to remove the violations within 10 working days of receipt of the information, unless otherwise established by a legally effective court decision.

21. Registrar shall suspend use of the domain name for the period of elimination of violations by making an appropriate record in the register.

22. When Registrant removes indicated violations, the use of the domain name is renewed within one working day by making an appropriate entry into the register.

23. The use of the domain name in the space of the Kazakhstan segment of the Internet stops when:

  • 1) there is a registrant's request to terminate of a domain name registration;
  • 2) expiration of an agreement between Registrar and Registrant;
  • 3) not to eliminate violations which caused the suspension of a domain name within the specified period in the information registry;
  • 4) a court decision entered into force on the termination of the use of the domain name.

24. In the case of one of the conditions referred to in paragraph 23 of the present Rules, Registrar sends to the registrant information on the termination of the agreement.

25. In the cases referred to in subparagraphs 1) and 2) of paragraph 23 of the present Rules, termination of a domain name registration who makes the relevant entry into the Registry.

26. In the cases referred to in subparagraphs 3) and 4) of paragraph 23 of the present Rules, termination of a domain name registration is executed by Registry who makes the relevant entry into the Registry and informs Registrar.

4. Order of allocation of domain names in the space of the Kazakhstan segment of the Internet

27. Allocation of domain names in the space of the Kazakhstan segment of the Internet is based on free access to information about registered domain names and reserved domain names of the second level.

Disputes relating to the allocation of domain names are dealt with by the administrator or by the courts.

28. The reserved domain names of the second level and subsequent levels include:

  • 1) EDU.KZ - intended to register third level domain names for organizations which are residents of the Republic of Kazakhstan, carrying out educational activities;
  • 2) GOV.KZ - intended to register third level domain names for the government of the Republic of Kazakhstan;
  • 3) MIL.KZ - intended to register third level domain names for the bodies of the Ministry of Defense of the Republic of Kazakhstan.

29. Distribution of the third-level domain names, with the exception of the reserved domain names, is implemented in accordance with the present Rules.

30. Allocation of the reserved domain names is carried out at the requests which are relevant to the activities of the paragraph 28 of the present Rules.

5* information about DNS-servers:

  • 1) * address of the primary DNS-server;
  • 2) * address of the secondary DNS-server;
  • 3) additional addresses of DNS-servers.

6. A copy of the document confirming registration of a trademark on the territory of the Republic of Kazakhstan.
